Vivun Inc. and its affiliates (collectively "Vivun", "we" and "us"), value your privacy and respect your interest in knowing how information about you is collected and used. This Privacy Policy describes Vivun's practices regarding the collection, use and disclosure of the information we collect from and about you when you use Vivun's web-based and mobile applications and Vivun's websites (including Vivun.co) that link to this Policy (the "Services").

Vivun collects personal data about you directly from you, from others (e.g., your employer if you use an enterprise account), and automatically when you use the Services. We process your information when necessary to provide you with the Services that you have requested, where we have obtained your prior consent, or where we have a legitimate interest to do so.

Vivun collects information from you through account and product registration, the Services you use, requests or questions submitted via forms or email, communications with us, participation in sweepstakes or research studies, uploads or posts to the Services, and support requests.

The types of data we collect directly from you may include:

Content. In using the Services, you may upload or input various types of content, including tasks, attachments, client names, account information, opportunity data, product information, and conversations (the "Content"). Our Customers, and not Vivun, determine their own policies regarding storage, access, modification, deletion, sharing, and retention of Content.

Payment Information. If you purchase a paid subscription, we utilize a third-party payment processor to collect billing information. The third-party service provider, not Vivun, stores your payment information on our behalf.

Information about others. If you use our invitation service to invite a friend to the Services, we will ask for that person's contact information and store it to send the invitation and track the success of our referral program.

If you use third-party integrations (e.g., Jira, Rally, CA Technologies, GitHub, Slack) through the Services, such providers may allow us to access and store additional information about your interaction with those platforms. If you do not wish to have this information shared, do not initiate these connections.

We may receive additional information about you, such as demographic information, from affiliates and third parties — such as business partners, marketers, researchers, and analysts — in order to better service your account and provide more relevant assistance.

We may use information we collect (e.g., usernames, IP addresses, unique device identifiers) to locate the same unique users across multiple browsers or devices in order to save your preferences and analyze usage of the Services.

We will normally collect personal information where we have your consent, where we need it to perform a contract, or where the processing is in our legitimate interests and not overridden by your data protection rights. Third parties or affiliates may administer Vivun advertising on non-Vivun websites. These parties may set and access cookies or use other tracking mechanisms to target ads to you based on your online behavior. You may visit the Network Advertising Initiative's Consumer Opt-Out link or the Digital Advertising Alliance's Consumer Opt-Out link to opt out of tailored advertising.

There is no uniform standard for responding to Do Not Track signals. At this time the Services do not function differently based on a user's Do Not Track signal.

We will not sell information about you to a third party or allow a third party to use information we provide for its own marketing purposes. We may share information about you as follows:

The Services contain links to third-party websites and third-party integrations. Because these sites and services are not operated by Vivun, Vivun is not responsible for their content or practices. The collection, use, and disclosure of your information will be subject to the privacy policies of those third parties, not this Policy. We urge you to read the privacy and security policies of these third parties.

The Services are intended for general audiences and not for children under the age of 16. If we become aware that we have collected personal information from children under the age of 16, we will take reasonable steps to delete it as soon as practicable.

Where you have provided consent, you may withdraw your consent at any time, without affecting the lawfulness of the processing carried out prior to withdrawal. If you are dissatisfied with the way we process your information, you may lodge a complaint with the data protection authority ("DPA") in your jurisdiction.

International Data Transfers. Your personal information may be transferred to, and processed in, countries other than the country in which you are resident. Our website servers are located in the United States, and our third-party service providers operate around the world. We have taken appropriate safeguards to require that your personal information will remain protected in accordance with this Policy. Our Standard Contractual Clauses can be provided on request.

We will retain your information for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or securely store it and isolate it from further processing until deletion is possible.

Vivun reserves the right to amend this Policy at any time to reflect new services, changes in our personal data practices or relevant laws, or advances in technology. We will make the revised Policy accessible through the Services, so you should review the Policy periodically.

If we make a material change to the Policy, you will be provided with appropriate notice and we will seek your consent to the updated Policy in accordance with legal requirements.

Vivun takes technical and organizational measures to protect your personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access. However, no method of transmission over the Internet, and no means of electronic or physical storage, is absolutely secure.
